PRESIDENT Mugabe has slammed a recent North Gauteng High Court ruling urging South African authorities to probe alleged human rights abuses in Zimbabwe and bring perpetrators before the International Criminal Court for prosecution.
He said the ruling constituted interference and a direct assault on the country’s sovereignty by residual Rhodesian and Apartheid forces in South Africa.
The President urged the African National Congress to deal decisively with the matter.
He made the remarks while officially opening a summit of former Sadc liberation movements in Harare.
“Naturally, as we develop and enact policies to deliver on these promises to our people such as our land reform programmes and the ongoing indigenisation and empowerment programmes here in Zimbabwe, we are targets for regime change.

“In this context, it is important to remember that this Harare meeting takes place after the recent ruling by one Boer Judge Hans Fabricius in the North Gauteng High Court in South Africa calling on authorities in that country to probe alleged atrocities in Zimbabwe, arrest and prosecute alleged offenders under the International Criminal Court of which South Africa is a party and Zimbabwe is not.
“Needless to say, we take umbrage at these residual Rhodesian and Apartheid forces that are finding space in our midst, to use our courts in a manner that seeks to mollify their defeat at the hands of our liberation struggles and reverse the gains that we have attained for our collective peoples.
“That judgment, like those outrageous ones of the Sadc Tribunal which has now been dissolved, constitutes a direct assault on our sovereignty by shameless forces afflicted by racist nostalgia.”
He urged the ANC to take action.
“I wish to urge our colleagues in the ANC of South Africa to see this for what it is and apply every means at their disposal to ensure that such machinations are not in the end, allowed to negatively affect our cordial relations.”
The President urged delegates to the summit to digest the issue and “pronounce itself clearly against that judgment as one of its resolutions”.
Last month, Judge Fabricius gave a ruling ordering the South African government to investigate alleged State-sponsored violence and crimes against humanity allegedly committed by Government officials in Zimbabwe in 2007.
The ruling followed litigation in March by the Southern Africa Litigation Centre and the Zimbabwe Exiles Forum.
Their case was based on a dossier detailing alleged attacks on MDC supporters in 2007 handed to the South African National Prosecuting Authority in 2008, but no formal investigations were launched.
President Mugabe challenged the former liberation movements --- Zanu-PF, ANC, MPLA (Angola), Frelimo (Mozambique), Chama Chamapinduzi (Tanzania) and Swapo of Namibia --- to be proactive in the face of open aggression by the former colonisers.
He said such summits should not turn into talking shops that do not benefit citizens.
“We want resolute and focused implementation of resolutions with tangible results, that has been our hallmark of the struggle, please make it remain so.
“Lest we forget, the purpose of these meetings is to accord former liberation movements an opportunity to deliberate, agree and develop joint strategies to enable us to retain the power we won on behalf of the people.
“This is urgent given that our revolutionary ideologies have come under sustained attack, nay, renewed attack from our erstwhile colonial masters who are determined to replace our revolutionary parties with malleable, neo-liberal stooge parties deliberately formed, built and funded to reverse all the gains of our liberation struggles,” President Mugabe said.
He narrated how the West formed the MDC in 1999 in a bid to reverse the gains of the liberation struggle and went on to locate the hands of the imperialists in uprisings in Tunisia, Egypt, Yemen, Ivory Coast and Libya.
“Now being checked in Syria and contained in Iran, this predatory advancing wave of Western liberal imperialism is searching most desperately for other avenues of least resistance in which to express itself.
“We do not have to look far to see the West’s dark hand behind the current disturbances in Mali and Guinea Bissau. See how the carnal forces now seek the imminent balkanisation of Mali into smaller states and similar fragmentation of Libya into three or more separate states.
“As liberation movements, we need to closely watch these and other unfolding situations in the Horn of Africa, in order to be fully alerted to the key role players of Africa’s destabilisation, establish their intentions and conceive ways and means of resisting the savagery of their actions. Africa should never be a colony again!” President Mugabe said.
He said Southern Africa, having been the last frontier of colonialism and by virtue of its high concentration of liberation movements in national politics, was regarded as inimical to the West’s fundamental interests.
The President explained how the inclusive Government came about following the 2008 elections reiterating that its term had expired and the country should go for elections.
He bemoaned the delay in the drafting of a new constitution by Copac that had gobbled over US$40 million laying the blame on the MDC formations and its Western handlers who fear losing the polls to Zanu-PF.
President Mugabe said drafting of the country’s first constitution after Independence in 1980 took “a matter of weeks” yet current Copac efforts have gone for over three years.
“If the new Constitution cannot be finished we are saying there is nothing wrong with the old Constitution. We amended the Lancaster House (Constitution) several times,” he said.
President Mugabe clarified that the Global Political Agreement was never about writing a new Constitution, but creating a conducive environment for the holding of elections.
He said cases of violence have decreased significantly now.
President Mugabe illustrated how the illegal sanctions have paralysed the economy and dismissed the notion that the embargo was targeted.
He warned liberation movements in the region to guard against internal destruction borne out of the desire by some in the ranks of the revolutionary political parties to become leaders.
“The revolutionary parties should watch for tendencies on the part of some within us to want to get to the top or find some ways of being separate or the tendency to be bought over. The West, West, West, is our worst enemy. They will always come clandestinely and want to divide us,” President Mugabe said.
He said such attempts were made in Zanu-PF during the 2008 elections and the party went to the polls divided.
“We have learnt our lessons although there are some people who would never learn. There is always the hand of the enemy,” President Mugabe said.
He said there was also nostalgia by the imperialists to remove governments led by liberation movements from office on the basis that they have stayed in power for too long.
“The democratic path requires that the people decide. It is not the number of years. Parties do not retire, but individuals do. If you can stay permanently in power and the people want you, then you can continue. That is democracy,” President Mugabe said.
The former liberation movements are represented by their secretaries-general.

Harare - Zimbabwe's president said on Friday he wants South Africa's ruling African National Congress to block an investigation in South Africa into alleged violence and atrocities by loyalists of his party.

President Robert Mugabe, speaking at a convention of southern African liberation movements in Harare, called the probe ordered by a South African court a "racist assault" by embittered Zimbabwean and South African whites.

In May, a South African judge ordered his country's prosecutors to investigate alleged human rights abuses and torture in Zimbabwe in a case filed by a human rights group and Zimbabwean exiles.

Those who brought the case, both whites and blacks, say they have documented abuses and envision a trial in South Africa.

Mugabe urged South African leaders to "apply every means at their disposal" to prevent the case souring relations between the two countries that fought a common struggle to end white rule.

He said whites in southern Africa, including white Judge Hans Fabricius who made the probe ruling, are trying to makes excuses for their defeat by the forces of African liberation.

He called the judge "a boer", and said Fabricius has no jurisdiction in Zimbabwe and does not understand the way international law works.

"That judgment by that boer... constitutes a direct assault on our sovereignty by shameless forces afflicted by racist nostalgia," Mugabe told a group of leaders from former regional liberation movements.

The ruling came at the instigation of those "still in our midst yearning for the old flags" of Rhodesia, as Zimbabwe was known before independence in 1980, and apartheid-era South Africa, Mugabe insisted.

He told representatives of the liberation groups of the ANC, Angola, Mozambique, Namibia, Tanzania and Zimbabwe that Africa has come under renewed attack from former colonisers determined to replace revolutionary parties with "malleable stooges."

His party is not going to relinquish power without fighting to defend its role in achieving independence, Mugabe said.

Mugabe, 88, has been in power since independence from Britain. He was forced by regional leaders to form a coalition government with the former opposition leader, Prime Minister Morgan Tsvangirai , after violent and disputed elections in 2008.

Mugabe has been nominated as the sole candidate for his party in elections he has called for this year to end the troubled three-year coalition. He has not groomed a successor to take over the fractious party.

He acknowledged on Friday that his party lost votes in strongholds in the 2008 polls and said that some of his lawmakers are now afraid to contest a new poll against Tsvangirai's Movement for Democratic Change.

But the party could still rule permanently with its traditional support, he said.

"Parties don't retire, its persons who retire. We cannot say we have stayed too long in government so that we should give others a chance to rule," he said.

In South Africa, the judge's ruling is likely to be tied up in appeals for some time before any probe starts.

Johncarlos, you can be sure Mugabe's future is a good deal shorter than his history, but then its not short enough. The journalist who wrote this article staed that boere was a perjorative term. As I remember it, it has been a term of pride among asection of the community, as in "boer maak n' plan". If you wear a name with pride it remains just that. Clearly Mugabe has spent too much time with wee Julius and his ilk. He also wishes to protect himself and his fellow criminals from the courts, this may work in Zimbabwe but I got bad news for him the rest of the world is itching to put him in front of a court.

Sadly Mugabe turned the "breadbasket of Africa" into a very dismal welfare case. I worked there for quite some time and saw how the local people suffer while Mugabe's elite live in exuberant luxury, no sympathy whatsoever for the general people. Mugabe, probably the only service you rendered is to serve as warning what can be done to a beautiful and prosperous nation. The same could be said for those who think "Good riddance to foreign investors!"

Judge Fabricius is not a racist. He fought racism as ealrly as the seventies. He was opposed to apartheid as a member of the PFP. He helped the Deputy Chief Justice Moseneke with his admission as an advocate when the application was opposed because Moseneke had a criminal record for being detained at Robben Island. He gave a landmark judgment for the Road Accident Fund that capped the losses. He is one of the best judges in this country.

Simphiwe - Every week I read of problems of number of displaced Africans migrating legally or illegally to the more stable / affluent countries such as S.Africa (and today's report on Africans in Israel).

So there is a conflict in my mind of respecting sovreignity of e.g. Zimbabwe vs Addressing Human Rights violations - that are a cause of so many people fleeing that country. And with the 1 party dictatorship stranglehold on security forces, police, judicial system, media - plus a less than quite genocide that took place / takes place of non-Zanu-PF supporters .... your suggestion that Zim people solve their own problems is not really realistic?

And no - S.Africa cannot play African UN or "USA" ...but there sure is a very, very big problem in too many african countries causing so many migrants and refugees ....... What is the solution to that?

The solution did come from the people of Zimbabwe - they voted out the ZANU-PF and Mugabe in 2008. Guess who is still in power? Your type was begging the UN to interfere in the domestic affairs of Apartheid RSA. But the moment a "brother leader" is in power they can essentiall wage war against their citizens and it is OK - no outside intervention required. Where does this pathetic and shameful attitude come from? It is that attitude that characterizes the general governance failure in Africa.

End result - the people suffer more than under colonialism while the leaders and their cronies run the countries like gangsters. Of course colonialism is blamed for all of this.

Anyone who thinks the struggle in Africa was about ending 'white rule' is just sadly small-minded. Talking about 'white'-anything is the same as talking about 'black'-anything. If all whites are racist overlords, as Mugabe claims, then all blacks are murderous thieving thugs. Neither satement, of course, is true! As long as people are lazy, stupid or evil enough to blame an entire group for the actions of some members of that group, we will have racial divisions. Mugabe is growing old and still getting strong against anyone who opposes him. He is still determined to rule Zim for a number of more years too so he sees this probe as a threat to him. For sure Mugabe has support on this matter as well as he is good at influencing others. They are baring the brunt of his selfishness and arogancy. What I commend about him is, he got rid of inequality and the issue of land reform. Johncarlos, you can be sure Mugabe's future is a good deal shorter than his history, but then its not short enough. The journalist who wrote this article staed that boere was a perjorative term. As I remember it, it has been a term of pride among asection of the community, as in "boer maak n' plan". If you wear a name with pride it remains just that. Clearly Mugabe has spent too much time with wee Julius and his ilk. He also wishes to protect himself and his fellow criminals from the courts, this may work in Zimbabwe but I got bad news for him the rest of the world is itching to put him in front of a court.

Sadly Mugabe turned the "breadbasket of Africa" into a very dismal welfare case. I worked there for quite some time and saw how the local people suffer while Mugabe's elite live in exuberant luxury, no sympathy whatsoever for the general people. Mugabe, probably the only service you rendered is to serve as warning what can be done to a beautiful and prosperous nation. The same could be said for those who think "Good riddance to foreign investors!"

Judge Fabricius is not a racist. He fought racism as ealrly as the seventies. He was opposed to apartheid as a member of the PFP. He helped the Deputy Chief Justice Moseneke with his admission as an advocate when the application was opposed because Moseneke had a criminal record for being detained at Robben Island. He gave a landmark judgment for the Road Accident Fund that capped the losses. He is one of the best judges in this country.

Simphiwe - Every week I read of problems of number of displaced Africans migrating legally or illegally to the more stable / affluent countries such as S.Africa (and today's report on Africans in Israel).

So there is a conflict in my mind of respecting sovreignity of e.g. Zimbabwe vs Addressing Human Rights violations - that are a cause of so many people fleeing that country. And with the 1 party dictatorship stranglehold on security forces, police, judicial system, media - plus a less than quite genocide that took place / takes place of non-Zanu-PF supporters .... your suggestion that Zim people solve their own problems is not really realistic?

And no - S.Africa cannot play African UN or "USA" ...but there sure is a very, very big problem in too many african countries causing so many migrants and refugees ....... What is the solution to that?

The solution did come from the people of Zimbabwe - they voted out the ZANU-PF and Mugabe in 2008. Guess who is still in power? Your type was begging the UN to interfere in the domestic affairs of Apartheid RSA. But the moment a "brother leader" is in power they can essentiall wage war against their citizens and it is OK - no outside intervention required. Where does this pathetic and shameful attitude come from? It is that attitude that characterizes the general governance failure in Africa.

End result - the people suffer more than under colonialism while the leaders and their cronies run the countries like gangsters. Of course colonialism is blamed for all of this.

Anyone who thinks the struggle in Africa was about ending 'white rule' is just sadly small-minded. Talking about 'white'-anything is the same as talking about 'black'-anything. In any country (house) there's a father or head of house. As far as Zim goes, we chose uncle Bob! We are the safest country in Africa prob in the top ten in the world!!! We know the rules of our house! We have gone thru the worst times where SA benefited from us not having food on shop shelves, highest inflation in history but uncle Bob stayed and didn't change his stance!! We are still one of the most educated nation on earth and even tho our unemployment rate is high, we getting by!! Sort out yr own probs!! We'll keep our Zim u keep yr whatever!! Mugabe is growing old and still getting strong against anyone who opposes him. He is still determined to rule Zim for a number of more years too so he sees this probe as a threat to him. For sure Mugabe has support on this matter as well as he is good at influencing others. Gullible Zuma is likely to disagree with Mugabe though as he is heavily influenced by those 'boers' heavily as he even agreed to their e-toll proposal so when it comes to puppet ANC, Mugabe is alone at this one.

Uncle Bob became so bitter with whites, the day they castricted his man-hood. Do you blame him for that???. Unfortunately, his hatred for whites counter revolutionize his people. They are baring the brunt of his selfishness and arogancy. What I commend about him is, he got rid of inequality and the issue of land reform.
